INITIAL PROVISIONS
These Terms of Use of the Broaddy service (hereinafter as "Terms") govern
the use of the Broaddy service (hereinafter as "Service") provided by
Broaddy s.r.o., company ID 055 09 585, based at Pod Bání 2003/21, Libeň,
180 00 Praha 8 Czech Republic, an association registered in the register
administered by the Municipal Court in Prague, section C entry 264594
(hereinafter as "Provider").
The service is available only to persons registered with the Service
(hereinafter as "Authorized Users"), through which they can connect and
communicate with each other and do other activities. The purpose of
providing the Service is to enable the connection between mentees (e.g.
international students) and mentors (local student-buddies). The range of
Authorized Users and scope of the Service is determined by a Contract
between the Provider and the third party who has ordered the Service (the
"Client") in favor of the Authorized Users. By agreeing with these Terms,
every Authorized User demonstrates compliance with the conditions that were
negotiated between the Client and the Provider in the Contract to access
the Service (e.g. in case of a student or a member of the Client etc).

TERMS OF USE OF THE SERVICE
1)
a)
Availability
Access to the Service through web browsers on devices of Authorized Users
and its use is free of charge. In order to use of the Service it is
required to have an internet browser installed on Authorized Users'
devices.
Authorized Users are allowed to use the Service pursuant to registration
within the Service interface. Authorized Users also bear the costs incurred
by them related to accessing and using the Service (i.e. internet
connection expenses etc.).
The Provider is not responsible for the event of the Service not being
available due to malfunction or Internet service reasons attributable to
the Authorized User. Likewise the
Provider is not responsible for any possible problems of the Authorized
User while using the
Service, particularly as a result of failure or device errors of the
Authorized User or improper use of the Service. Authorized User
acknowledges that the Service may not be available continuously, especially
with regard to the necessary maintenance of hardware and software. The
Service is free of charge for Authorized Users, therefore the Provider is
not liable for any damage caused to Authorised Users. Authorized Users also
acknowledge that not all the Service functionalities, as defined in the
division of roles below, are always available.
Authorized Users also acknowledge that the Service is made available to
them only on the basis of the Contract between the Provider and the Client.
The Service can be terminated at any time, especially in case of a
termination of the Contract between the Provider and the
Client. The Provider is not obliged to backup the data entered into the
Service user interface by the Authorized Users and no data will be returned
to Authorized Users at the Service termination as they will be deleted.
b)
Account
In order to use the Service, the Authorized User is required to register
and within the process of registration to provide his personal data stated
in Article 2 of these Terms, depending on the respective Authorized User’s
role. These personal data will be disclosed within the Service to the
Provider, The Client and Authorized Users under the conditions set forth in
these Terms. The Authorized User is required to provide true and up-to-date
personal data. The Authorized User is aware that the contact details
provided in his/her user account may be used by other Authorized Users as
well as by the Provider for the purpose of communication with each other in
connection with the Service.
Based on the Authorized User's registration to use the Service, the
Authorized User can access their account, whereby they can connect and
communicate with other Authorized Users according to the relevant role that
is assigned to them. The Authorized User is obliged to maintain
confidentiality regarding the information necessary to access their
account. The terms and conditions regarding processing of personal data in
relation to the account and the use of the Service are enclosed in a
separate document (privacy policy), the Authorized User was informed about
this document before using the Service.
The Provider may delete an account for any reason, particularly if the
Authorized User’s account is not used for more than one year, or if the
Authorized User violates these Terms or violates legislation while using
the Service or in relation to it.
The Provider is entitled to terminate the legal relationship established by
these Terms by deleting the Authorized User’s account at any time. The
Authorized User is entitled to delete their own account by a procedure in
the Service, whereby the legal relationship under these Terms expires.
c)
Authorization
The Authorized User is not entitled to use the Service for a different
purpose than for which it was provided. In particular, the Authorized User
is not entitled to reproduce, distribute, publish, decompile, change or
modify the computer program and / or other components of the work
(including copyright work), which are part of the Service.
Authorized Users are obliged to comply with the legislation of the Czech
Republic, to communicate with other Authorized Users with propriety, to
comply with their and other Authorized User’s legitimate interests, to heed
the good reputation of the Provider and the Client. Furthermore, they are
obliged to respect the rights of other Authorized Users and third parties,
they are obliged not to discriminate other Authorized Users based on
gender, race, color, language, faith and religion, political or other
opinion, national or social origin, national or ethnic minority, wealth,
ancestry or other status, and in this context not to insult nor to oppress
anyone.
Authorized Users must also ensure the protection of personal data to which
they have access, maintain confidentiality regarding information that is
considered confidential, i.e. especially those which are, or could be part
of a trade secret, as well as those whose disclosure could harm to the
Provider, the Customer and / or Authorized Users.
The extent to which Authorized Users can use the Service is subject to the
role assigned to them by the Admin.
2)
ROLES OF AUTHORIZED USERS
a)
Mentor (e.g. Local Buddy)
In order to register within the Service:
1. The Mentor (e.g. Local Buddy) is obliged to provide this information:
name, surname, date of birth, contact details (e-mail address, telephone
number), login credentials, gender, and information about study
(affiliation to college or faculty).
2. In order to fully use the Service the Mentor (Local Buddy) may also
provide information about his/her character and hobbies, number of the
student card, and information regarding participation in student events.
Is entitled to:
1. Browse all Mentor requests (Buddy requests) made by Mentees (e.g.
International Students). Only information about gender, home country, home
school or university and voluntarily filled-in hobbies/additional
information are disclosed. Name and contact information are not visible.)
2. Accept the Mentor requests (Buddy requests) made by Mentees (e.g.
International Students). After the successful pairing the Mentor (e.g.
Local Buddy) is able to see the name and contact information of the Mentee
(e.g. International Student) they paired with.
b)
Mentee (e.g. International Student)
In order to register within the Service:
1. The Mentee (e.g. International Student) is obliged to provide this
information: name, surname, date of birth, contact details (e-mail
address), login credentials, gender, information about study (affiliation
to home school or university, affiliation to host college or faculty), home
country and information on student visit (semester of arrival, location of
arrival and date of arrival).
2. In order to fully use the Service the Mentee (e.g. International
Student) may also provide information about his/her character and hobbies,
telephone number, note about arrival (e.g. flight number), number of the
student card and information regarding participation in student events.
Is entitled to:
1. Request to be paired with a Mentor (e.g. Local Buddy). This means that
the Mentee (e.g. International Student) can be paired with a Mentor (e.g.
Local Buddy), based on gender, home country, home school or university and
voluntarily filled-in hobbies/additional information. Upon being chosen by
a Mentor (e.g. Local Buddy), name and contact information are mutually
revealed.
2. Ask for a pickup - based on registered arrival date and place.
3. Withdraw the Mentor (Local Buddy) Request, unless it has been already
accepted by a Mentor (e.g. Local Buddy). In this case it is necessary to
contact the Mentor coordinator (Buddy Coordinator), whose email is
displayed in the footer of the interface.
4. Edit their own personal data within the Service
5. Find the name and contact information of the Mentor (e.g. Local Buddy)
who accepted their Mentor request (Buddy request).
6. Browse Events (e.g. social, cultural, sport…) available for Mentees
(e.g. International Students), or those they have attended.
c)
Event Manager
(this role is assigned to Mentors by Admin only)
Is entitled to:
1. Everything that a Mentor is entitled to.
2. Create, edit or delete an Event (e.g. social, cultural, sport…).
3. Register Mentees to an Event, or Unregister them from Events.
d)
Mentor Coordinator (Buddy Coordinator)
(this role is assigned to Mentors by Admin only)
Is entitled to:
1. Everything that a Mentor is entitled to.
2. See the personal data of all Authorized Users.
3. Accept a new Mentor’s registration.
4. Delete registered Mentees and deactivate registered Mentors.
5. To see which Mentees a particular Mentor has paired with (or to which
Mentor a particular Mentee belongs to).
6. Cancel the connection between a Mentee and a Mentor or manually pair a
Mentee and a Mentor.
7. View the rankings that Mentees have given to Mentors.
8. Edit the name, surname, email a phone number of a Mentor or Mentee.
9. Limit the maximum number of Mentees that a Mentor is able to pair with.
e)
Admin
(this role is assigned to Mentors by Admin only. The first Admin role is
assigned to the first Customer’s account by the Provider).
Is entitled to:
1. Everything that a Mentor Coordinator (Buddy Coordinator) is
entitled to and provides the same personal data.
2. Assigning the roles Event Manager, Mentor Coordinator (Buddy
Coordinator) and Admin to registered Mentors.
3. To edit any data of all Authorized Users (both Mentees and Mentors)
4. To edit the basic application settings (i.e. institution name, logo,
contact email, semester dates, etc.)

COMMON PROVISIONS
These conditions are governed by law of the Czech Republic.
Supervision over the protection of personal data is performed by the Office
for Personal Data Protection. The Czech Trade Inspectorate supervises,
within the specified scope, over the compliance with Act no. 634/1992 Sb.,
on consumer protection, as amended.
Authorized User agrees to receive information related to the Service to the
electronic address of the person and also agrees with the storage of
so-called Cookies on their computer.
If the legal relationship established by these Terms includes an
international (foreign) element, then the both parties agree that the
relationship is governed by law of the Czech Republic.
In the event of a consumer dispute which is not resolved by mutual
agreement, the consumer may file a proposal for extrajudicial resolution of
such disputes to the designated authority of consumer disputes, which is:

PRIVACY POLICY AND INFORMATION ON DATA PROCESSING

Czech Republic, an association registered in the register administered by
the Municipal Court in Prague, section C entry 264594, as the provider
(hereinafter referred to as the "Provider") of the
Broaddy® service (hereinafter referred to as the "Service
") under the contract concluded via registration on the basis of the Terms
of use of Broaddy (hereinafter as the „Contract“), hereby
informs you about the manner and scope of processing the personal data of
the persons registered with the Service (hereinafter as the " Authorized Users"),
including the scope of the Authorized
User's rights in relation to such processing. This privacy policy is also
applicable to the situation before conclusion of the Contract, e.g. when
the Authorized User only uses the Provider’s website with an intent to
conclude the Contract.

1. What is the purpose of the data processing?
1.1. We process personal data for the purpose of concluding and
implementing contractual obligations. To do this, we process following
personal data depending on your role within the Service:
a) if you are a Mentor/ Local Buddy (also Buddy Coordinator or Admin),
these personal data are processed:
name, surname, date of birth, contact details (e-mail address, telephone
number), login credentials, gender, information about study (affiliation to
college or faculty), provided information about your character and hobbies,
number of your student card, your participation in student events, your
rankings, history of your mentor-mentee (buddy-student) connections,
information on communication with you, and information on your activity
within the Service (e.g. access logs and event logs).
b) if you are a Mentee / International Student, these personal data are
processed:
name, surname, date of birth, contact details (e-mail address, telephone
number), login credentials, gender, information about study (affiliation to
college or faculty), provided information about your character and hobbies,
your nationality, information on your student visit, number of your student
card, your participation in student events, your rankings, history of your
mentor/mentee (buddy-student) connections, information on communication
with you, and information on your activity within the Service (e.g. access
logs and event logs).
The processing of such personal data follows directly from the Contract and
is necessary for the fulfilment of our contractual obligations.
1.2. We keep the personal data also after termination of the Contract for
these purposes:
a) the protection of our rights and legitimate interests, particularly in
the case of legal disputes, court proceedings, etc., when it is necessary
to prove that we have acted in accordance with the law,
b) evidence of copyright,
c) compliance with our legal obligations, in particular accounting, tax
obligations, archiving obligations etc.
1.3. We do not perform any profiling or automated decision making.
1.4. In accordance will legal regulations, as you are our customer, we
shall send information from time to time about our services unless you
terminate your account or unsubscribe. We use your e-mail for this purpose.
2. From whom do we receive personal data and who we pass them on to?
2.1. Your personal data are accessible to other Authorized Users which can
use your contact information for mutual communication and also to the
Client.
2.2. We only collect personal data from you. We do not find out any data
other than those you give us. You are required to provide only accurate
data and if your personal data is changed, you must update the data.
2.3. We use the following processors to process your personal data:

2.4. We may process the personal data manually or automatically and may
involve our employees or other persons working for us (especially other
students working for Broaddy® project), including for the purpose of
removing errors, inaccuracies, etc. However, such persons may process
personal data only under the conditions and in the scope above and are
bound by the obligation to maintain confidentiality of personal data and
security measures whose disclosure would threaten the security of personal
data.
2.5. We always process personal data in accordance with applicable laws and
we provide them with due care and protection. We take care that you never
suffer any harm to your rights, in particular the right to the preservation
of human dignity. We also protect you from unauthorized interference with
your private and personal life.
2.6. We send automatic system notification emails to the email addresses of
Authorized Users. These emails are an inseparable part of the Service that
enable its functioning.
2.7. We send a feedback form once a year to the email addresses of
Authorized Users for research and development purposes. If you do not wish
to receive this feedback form, you have to write to info@broaddy.com.
3. How long do we process the personal data?
We keep the personal data, which your provided, during existence of your
account within the Service. After termination your account within the
Service, we are obliged to delete your personal data, but even after the
termination of your account within the Services, however, we are authorized
to continue processing personal data, which processing is necessary for the
following purposes:
3.1. Legitimate interests
We process personal data to protect our legitimate interests, i.e. to
defend ourselves against any claims of our customers, even before a court
(for example, during the respective limitation periods that may be in the
Czech Republic up to 15 years from the occurrence of a relevant event). In
this context, the Provider processes your name and surname, email and data
about the performance of the Contract (its content, information about its
fulfilment and your activity within the Service).
We cannot delete these data even at the request of the User because they
are not processed by consent. However, based on your request, we will
review whether data is no longer needed.
4. What are your rights?
4.1. In the first place, you have the right to ask us for access to your
personal data, including a copy of all your personal data, and you may also
request information about:
a) the purpose of the processing of personal data,
b) the personal data or, where appropriate, the categories of personal data
processed, including any available information on their source,
c) the nature of the automated processing, including profiling, and the
information relating to the procedure followed, as well as the significance
and foreseeable consequences of such processing for the data subject,
d) the recipients or categories of recipients of your personal data,
e) the time at which the personal data will be stored or, if it is not
possible, the criteria used to determine that time,
f) any available information about the personal data source, unless it is
obtained from you.
4.2. Your other rights are:
a) ask us for an explanation,
b) require us to eliminate the situation, in particular, it may be
blocking, correcting, supplementing, limiting or deleting personal data
(the right to be forgotten);
c) request personal data that concern you in a structured, commonly used,
and machine-readable format, and pass on these data to another controller
without an obstruction, in any way,
d) to ask a question, resp. a complaint to the Office for the Protection of
Personal Data,
e) object to the processing of personal data that concern you.
5. How do we protect your personal data?
We protect your data. The following security means are used:
